PRIVACY POLICY

Updated July 1, 2026

1. Introduction

The Harbour Vista Homeowners’ Association, Inc. (“the Association,” “we,” “our,” or “us”) is committed to protecting the privacy of visitors and residents who use our website (the “Site”). This Privacy Policy explains what information we collect, how we use it, and the choices available to you.

This Policy applies to information collected through the Site only. It does not apply to information collected by the Association through other means, including in-person interactions, written correspondence, or third-party property management platforms.

2. Information We Collect

We collect two categories of information through the Site:

A. Information You Provide Voluntarily

When you use certain features of the Site, you may provide us with information directly, including:

  • Your name and unit number when submitting a maintenance request

  • Your name, unit number, and preferred reservation dates when submitting a clubhouse or pool reservation form

  • Your name and any contact information you choose to include when submitting a community message for the bulletin board

You are not required to provide this information to browse the public portions of the Site. Providing information through these forms is voluntary; however, we may be unable to process your request without it.

B. Information Collected Automatically

Like most websites, our hosting infrastructure automatically records certain technical data when you visit the Site. This information is captured in standard server logs and may include:

  • Your Internet Protocol (IP) address

  • The type of browser and operating system you are using

  • The pages you visit on the Site and the date and time of your visit

  • The referring URL (the page you visited before arriving at our Site)

This information is collected for security, troubleshooting, and operational purposes. We do not use analytics platforms such as Google Analytics, and we do not deploy tracking cookies or behavioral advertising tools on the Site.

3. How We Use Your Information

Information collected through the Site is used solely for the following purposes:

  • To process and respond to maintenance requests, reservation inquiries, and other submissions

  • To facilitate communication between residents and the Board of Directors

  • To moderate and, at the Board’s discretion, publish community messages on the bulletin board

  • To maintain the security and integrity of the Site

  • To comply with applicable legal obligations

We do not use your information for marketing purposes, and we do not sell, rent, or trade your personal information to any third party.

4. Sharing of Information

We do not sell or share your personal information with third parties for commercial purposes. We may share information in the following limited circumstances:

  • With Board members, officers, or authorized volunteers to the extent necessary to fulfill your request or address a community matter

  • With service providers engaged by the Association to assist with website hosting or maintenance, who are contractually obligated to protect your information

  • As required by applicable law, court order, or governmental authority

  • To protect the rights, property, or safety of the Association, its members, or others

Community messages approved for display on the bulletin board will be visible to all users with access to the resident-only portion of the Site. Do not include sensitive personal information in bulletin board submissions.

5. Community Password and Access

The resident-only areas of the Site are protected by a shared community password rather than individual user accounts. Because access is shared, the Association is not able to track or log individual user activity within Restricted Areas. Residents are responsible for maintaining the confidentiality of the community password and should report any suspected unauthorized disclosure to the Board at info@harbourvista.com.

6. Data Retention

Server log data is retained for a limited period as required for security and operational purposes, after which it is deleted or anonymized. Information submitted through forms (maintenance requests, reservation requests, community messages) is retained for as long as necessary to process the request and for any applicable record-keeping period required under the Association’s governing documents or California law.

7. Security

We take reasonable technical and administrative measures to protect the information collected through the Site from unauthorized access, disclosure, alteration, or destruction. However, no method of transmission over the internet or electronic storage is completely secure. We cannot guarantee absolute security and encourage residents to exercise caution when submitting personal information online.

If you believe your information has been compromised or that there has been unauthorized access to the Site, please contact us promptly at info@harbourvista.com.

8. Children’s Privacy

The Site is not directed to children under the age of 13. We do not knowingly collect personal information from children under 13. If we become aware that we have inadvertently collected information from a child under 13, we will take steps to delete that information promptly.

9. California Privacy Rights

As a California-based organization, we are mindful of rights afforded to California residents under applicable state law, including the California Consumer Privacy Act (CCPA) and related regulations. Given the limited nature of the data we collect — which is not sold or used for commercial purposes — and the community-member context of this Site, many CCPA provisions may not apply. However, California residents may contact us at info@harbourvista.com to:

  • Request information about what personal data we hold related to them

  • Request deletion of personal data we hold, subject to applicable retention obligations

We will respond to verifiable requests within the timeframes required by law.

10. Third-Party Links

The Site may contain links to external websites not operated by the Association. This Privacy Policy does not apply to those sites. We encourage you to review the privacy policies of any third-party sites you visit.

11. Changes to This Policy

We may update this Privacy Policy from time to time. Changes will be posted on the Site with a revised effective date. Your continued use of the Site following any changes constitutes acceptance of the updated Policy. We encourage residents to review this Policy periodically.
